Over 90% of the organs transplanted in China before 2010 were procured from prisoners. Although Chinese officials announced in December 2014 that the country would completely cease using organs harvested from prisoners, no regulatory adjustments or changes in China’s organ donation laws followed. As a result, the use of prisoner organs remains legal in China if consent is obtained. We have collected and analysed available evidence on human rights violations in the organ procurement practice in China. We demonstrate that the (...) practice not only violates international ethics standards, it is also associated with a large scale neglect of fundamental human rights. This includes organ procurement without consent from prisoners or their families as well as procurement of organs from incompletely executed, still-living prisoners. The human rights critique of these practices will also address the specific situatedness of prisoners, often conditioned and traumatized by a cascade of human rights abuses in judicial structures. To end the unethical practice and the abuse associated with it, we suggest to inextricably bind the use of human organs procured in the Chinese transplant system to enacting Chinese legislation prohibiting the use of organs from executed prisoners and making explicit rules for law enforcement. Other than that, the international community must cease to abet the continuation of the present system by demanding an authoritative ban on the use of organs from executed Chinese prisoners. Organ donation after brain death has been practiced in China since 2003 in the absence of brain death legislation. Similar to international standards, China’s brain death diagnostic criteria include coma, absence of brainstem reflexes, and the lack of spontaneous respiration. The Chinese criteria require that the lack of spontaneous respiration must be verified with an apnea test by disconnecting the ventilator for 8 min to provoke spontaneous respiration. However, we have found publications in Chinese medical journals, in which the donors (...) were declared to be brain dead, yet without an apnea test. The organ procurement procedures started with initiating “intratracheal intubation for mechanical ventilation after brain death,” indicating that a brain death diagnosis was not performed. The purpose of the intubation was not to resuscitate the patient but rather was directly related to facilitating the explantation of organs. Moreover, it was unmistakably stated in two of these publications that the cardiac arrest was induced in these patients without brain death determination by cold St. Thomas cardioplegic solution or other cold myocardial protection solutions. This means that the condition of these donors neither met the criteria of brain death nor that of cardiac death. In other words, the “donor organs” may well have been procured in these cases from living human beings. Thus, brain death definition is abused in China by some individuals for organ harvesting, and a systematic investigation is needed to clarify the situation of organ donation after brain death in China. BackgroundIn December 2014, China announced that only voluntarily donated organs from citizens would be used for transplantation after January 1, 2015. Many medical professionals worldwide believe that China has stopped using organs from death-row prisoners.DiscussionIn the present article, we briefly review the historical development of organ procurement from death-row prisoners in China and comprehensively analyze the social-political background and the legal basis of the announcement. The announcement was not accompanied by any change in organ sourcing legislations or regulations. As a (...) fact, the use of prisoner organs remains legal in China. Even after January 2015, key Chinese transplant officials have repeatedly stated that death-row prisoners have the same right as regular citizens to “voluntarily donate” organs. This perpetuates an unethical organ procurement system in ongoing violation of international standards.ConclusionsOrgan sourcing from death-row prisoners has not stopped in China. The 2014 announcement refers to the intention to stop the use of organs illegally harvested without the consent of the prisoners. Prisoner organs procured with “consent” are now simply labelled as “voluntarily donations from citizens”. The semantic switch may whitewash sourcing from both death-row prisoners and prisoners of conscience. China can gain credibility only by enacting new legislation prohibiting use of prisoner organs and by making its organ sourcing system open to international inspections. Until international ethical standards are transparently met, sanctions should remain. (shrink)

The Transforming growth factor beta (TGF‐β) family of secreted proteins regulates a variety of key events in normal development and physiology. In mammals, this family, represented by 33 ligands, including TGF‐β, activins, nodal, bone morphogenetic proteins (BMPs), and growth and differentiation factors (GDFs), regulate biological processes as diverse as cell proliferation, differentiation, apoptosis, metabolism, homeostasis, immune response, wound repair, and endocrine functions. In Drosophila, only 7 members of this family are present, with 4 TGF‐β/BMP and 3 TGF‐β/activin ligands. Studies in (...) the fly have illustrated the role of TGF‐β/BMP ligands during embryogenesis and organ patterning, while the TGF‐β/activin ligands have been implicated in the control of wing growth and neuronal functions. In this review, we focus on the emerging roles of Drosophila TGF‐β/activins in inter‐organ communication via long‐distance regulation, especially in systemic lipid and carbohydrate homeostasis, and discuss findings relevant to metabolic diseases in humans. -/- . Résumé Avant de devenir l’un des pères fondateurs de l’école de Marbourg, Hermann Cohen avait rédigé un article dans lequel il cherchait à mettre en évidence les liens entre Heinrich Heine et le judaïsme. L’article révèle une double préoccupation : théologico-philosophique et politico-philosophique. Cohen affirmait que le panthéisme de Heine, inspiré de Spinoza, serait compatible avec le monothéisme juif, et que c’est ce panthéisme qui aurait mené Heine vers les « idées socialistes » que, comme Heine, il acceptait. Cohen changea (...) ensuite d’attitude envers Spinoza mais il demeura, sa vie durant, un grand admirateur de Heine, alors que Rosenzweig, qui pourtant se présenta comme l’héritier et le successeur de Cohen en pensée juive, développa une forte aversion contre le poète, ce qui ne peut être expliqué que si l’on prend en considération son propre engagement religieux. Le terme d'athéisme produit un sentiment trompeur de familiarité. Car l'athéisme ne s'arrête pas à la négation de Dieu et les Dieux ont cette propension à ressusciter sous d'autres formes, à quitter le royaume de la religion et de la théologie pour se réfugier dans le quotidien de nos vies. C'est ce que Marx dénomme la " religion quotidienne " qui déifie des réalités sociales et économiques comme la valeur, le capital, la marchandise, transformant celles-ci en puissances tutélaires et transcendantes (...) face auxquelles les hommes seraient à la fois impuissants et irrémédiablement soumis. Trois textes de Marx permettent ici de saisir le passage de l'opium du peuple au fétichisme de la marchandise, et le type de subversion politique que produit l'athéisme. Véritable " sport de combat ", l'athéisme consiste alors en une pensée de l'émancipation et de la démocratie par et pour un peuple qui se constitue par la critique toujours renouvelée des pouvoirs. Cette critique est le legs précieux de Marx : toutes les religions scellent la croyance que l'Histoire serait commandée par des forces sur lesquelles les hommes n'auraient pas de prise, et c'est pourquoi il faut les combattre. On désespère de trouver une théorie du pouvoir étatique chez Marx, mais il n’y a pas à désespérer de son absence. En effet son absence n’est pas le signe d’une insuffisance ou de son incapacité à comprendre le politique, mais elle est bien plutôt le résultat d’un déplacement dans la façon d’appréhender le pouvoir. Pour Marx le pouvoir est moins un problème d’origine que d’effet. La puissance d’un pouvoir se mesure à ses effets d’individuation. Marx est justement un grand penseur (...) du pouvoir car il court-circuite une théorie de l’État. Le pouvoir ne se montre pas dans la loi et le droit, mais sur les corps productifs que l’on discipline dans la grande industrie. L’analyse du capitalisme chez Marx repose sur une double définition du pouvoir : Comment créer des sujets conformes aux impératifs de la production capitalisme? C’est l’analyse de l’exploitation dans la production. Comment reproduire ce système? Comment faire accepter aux dominés la légitimité de leur domination. C’est tout le travail que Marx mène avec le fétichisme que l’on peut appeler la religion quotidienne du capitalisme. (shrink)

Erstaunlicherweise ist sie noch immer weithin unerforscht. Dieser Band geht auf eine Fruhkantianismus-Ausstellung der Universitat Jena (1993) zuruck. Er hilft, das Quellenmaterial leichter zu erschliessen. Kapitel uber Ch. G. Schutz, C. Ch. E. Schmid, die Allgemeine Literatur-Zeitung, Reinhold, Schiller, Hufeland u.a. geben neue Einblicke in diese fruhe Etappe der Kantrezeption. The first reception of Kant directly after publication of the Critique of Pure Reason is one of the most momentous and fascinating stages in the recent history of philosophy. Surprisingly not much research has been done on this. This volume is the result of an exhibition of early Kantianism at the University of Jena in 1993. It helps to make the source material more easily accessible. Chapters on Ch. G. Schutz, C. Ch. E. Schmid, the Allgemeine Literatur-Zeitung, Reinhold, Schiller, Hufeland among others provide new insight into this early stage of Kant's reception. There are approximately 100 illustrations which present very valuable source material, some of which was previously completely unknown. (shrink)

The ArgumentThis paper argues that the New Science, which was seen as essentially a public enterprise, was moreover a major constituent of the public sphere in early modern era. In seventeenth-and eighteenth-century Western Europe the sphere of public experimentation, testing, and discussion related to the new science, manifested, itself as a highly diversified, contested, and complex social field.Two general problems arose in constructing this cultural public sphere: the selection of participants in the debate and the inclusion of a heterogenous public (...) in the experimental scene. National authorities employed diverse policies but none denied the necessity of public debate for testing the validity of experimentations. The public sphere had to create its own conditions of existence by imposing manifold regulations in order to make these public meetings possible and enjoyable. These regulations emphasized common interest and the moral code as the most basic condition for rhe sustenance of the public sphere, thus enhancing self-restraint, tolerance, and politeness on the part of both discussants and participants. The more inclusive and heterogenous the public sphere, the more these norms were required. Thus the sphere of public debate constituted by early modern science implied a civilizing process, quite different from and more encompassing than the one analyzed by Norbert Elias. (shrink)

Comment est né l'Etat moderne que d'aucuns disent en crise? Quel rôle a-t-il joué dans la relative pacification des sociétés occidentales au cours des cinq derniers siècles? Une théorie de la civilisation peut-elle comprendre et expliquer Auschwitz? L'œuvre de Norbert Elias s'est confrontée sans faux-semblants aux principaux défis légués par le XXe siècle aux sciences humaines. Atypique et longtemps méconnue, cette sociologie historique assume la tentative de penser ensemble, et dans la longue durée, l'évolution des structures psychiques des individus (...) et celle des structures sociales des entités qu'ils forment. Aujourd'hui, les conséquences de la mondialisation et les questions soulevées par l'intégration européenne lui offrent une actualité nouvelle. Les transformations affectant l'organisation politique des hommes n'ont certes aucune raison de s'arrêter aux frontières des Etats-nations, peut-être appelés à disparaître sous l'effet d'interdépendances devenues planétaires. Mais quand l'appartenance à l'humanité peine à créer du sens, peut-on éviter que la communauté ne se fonde sur un sentiment, par définition toujours exclusif d'un " autre "? La tâche du sociologue se voit alors redéfinie : mettre les problèmes en histoire afin de les mettre à distance. De même que sa mission : rapprocher les individus en leur faisant connaître et reconnaître les liens qui les unissent. C'est à la lumière de cette double ambition que se laisse décrypter la réflexion d'Elias. Une réflexion sur le devenir de la civilisation et de l'Etat aussi originale que contestée, et dont les enjeux politiques et épistémologiques ne sauraient être dissociés. (shrink)

Sociologue hors normes, Norbert Elias, né en Allemagne en 1897, mort aux Pays-Bas en 1990, est considéré comme l'un des plus grands représentants de sa discipline. Son oeuvre n'a été introduite en France que dans les années 1970, mais bénéficie aujourd'hui d'une reconnaissance internationale et pluridisciplinaire. Pour introduire à cette oeuvre au croisement et de l'histoire, de l'anthropologie et de la psychologie et en restituer l'unité substantielle, Nathalie Heinich dégage d'abord les motifs sous-jacents aux grands travaux d'Elias sur le (...) processus de civilisation et ses choix : la contextualisation plutôt que la généralisation, les relations plutôt que les objets, la neutralité plutôt que le jugement de valeur. El presente trabajo conceptualiza la categoría de sufrimiento o dolor social desde un enfoque relacional y constructivista sobre la vida social y escolar. Particularmente, focalizamos en los desarrollos del psicoanálisis de Silvia Bleichmar, la sociología figuracional de Norbert Elias y el interaccionismo simbólico de David Le Breton. Sus perspectivas poseen una serie de puntos de confluencia: a) interpretan al sufrimiento como una emoción que imbrica procesos psico y sociogenéticos; b) conciben que el dolor remite a la relación entre cuerpo (...) y subjetividad; c) sostienen que el debilitamiento o la ausencia de lazos sociales significativos se encuentra en la base de las experiencias de padecimiento. We study the logic of so-called lexicographic or priority merge for multi-agent plausibility models. We start with a systematic comparison between the logical behavior of priority merge and the more standard notion of pooling through intersection, used to define, for instance, distributed knowledge. We then provide a sound and complete axiomatization of the logic of priority merge, as well as a proof theory in labeled sequents that admits cut. We finally study Moorean phenomena and define a dynamic resolution operator for (...) priority merge for which we also provide a complete set of reduction axioms. (shrink)

‘Mysticism means to isolate the eternal from the originated.’ This is not my definition of the word ‘mysticism’ but that of the founder of the ‘orthodox’ school of Muslim mysticism, Al-Junayd of Baghdad who flourished in the ninth century a.d . In actual fact it is not a definition of mysticism at all but of the Arabic word tawḥīd which means primarily ‘the affirmation of unity’; and that surely is an essential ingredient of any form of mysticism: it is the (...) affirmation through personal experience of unity either absolutely or in some qualified sense. As everyone knows, since the end of the Second World War there has been a sensational revival of interest in the non-Christian religions particularly in the United States and in this country. The revival has taken two forms, the one popular, the other academic. The first of these has turned almost exclusively to Hindu and Buddhist mysticism and can be seen as an energetic reaction against the dogmatic and until very recently rigid structure of institutionalised Christianity and a search for (...) a lived experience of the freedom of the spirit which is held to be the true content of mysticism, obscured in Christianity by the basic dogma of a transcendent God, the ‘wholly Other’ of Rudolf Otto and his numerous followers, but wholly untrammelled by any such concept in the higher reaches of Vedanta and Buddhism, particularly in its Zen manifestation. On the academic side the picture is less clear. There is, of course, the claim that the study of religion, like any other academic study, must be subjected to and controlled by the same principles of ‘scientific’ objectivity to which the other ‘arts’ subjects have been subjected, to their own undoing. But even here there would seem to be a bias in favour of the religions of India and the Far East as against Islam, largely, one supposes, in response to popular demand. (shrink)

The use of placebos in randomised controlled trials is a subject of considerable ethical debate. In this paper we present a set of considerations to evaluate the ethics of placebo controlled trials that includes: social value of the study; need for a randomised controlled trial and placebo; standards of care; risks of harm due to administration of placebo and the harm benefit balance; clinical equipoise; and double standards. We illustrate the application of these considerations using a case study of a (...) large ongoing multicentre, placebo-controlled, double-blinded, randomised trial to determine primaquine anti-relapse efficacy in vivax malaria. There is an urgent need for primaquine anti-relapse studies in order to rationalise the management of a potentially fatal disease. An ethical justification for the use of the placebo arm is provided on the grounds that the actual current applied standard of care in most endemic places does not include primaquine. It has also been argued that there is clinical equipoise among the primaquine study arms and that the risk of harms of being in the placebo arm is the risk of having relapse, which is no more than not being included in the trial, and that there are no double standards. Based on our set of considerations, we conclude that a placebo arm is not only justified but imperative in this study. We propose that similar considerations should be prospectively applied to other placebo controlled trials and observational control arms where no treatment is offered. (shrink)

Explanatory power is a complex theoretical virtue, not reducible to empirical strength or adequacy, which includes other virtues as its own preconditions. Since this virtue provides one of the main criteria by which theories are evaluated, it presents thus a challenge to any empiricist account of science. After a critical account of attempted explications of the concept of scientific explanation, this chapter offers a pragmatic account that identifies explanations with answers to why‐questions. Since such questions are set by the questioner, (...) and have their family of relevant direct answers determined by the presuppositions, values, and interests involved in the questioning, that makes explanation relative to contextual factors. On this understanding, evaluations of scientific explanation cannot play the role required for their use in support of scientific realism––and, incidentally, the large array of standard puzzles in the literature on this subject are solved.
